The faint hopes for cornerback Nyzier Fourqurean to play for the University of Wisconsin football team this fall are on their last breaths.
Fourqurean filed a motion for a preliminary injunction in his continuing fight against the NCAA regarding his eligibility on Tuesday, essentially asking Judge William M. Conley to step in and grant him eligibility because his case as currently scheduled will hold him out too much of the season. Fourqurean's case, which saw the senior win a preliminary injunction this spring but have that ruling reversed on appeal, was set for trial Sept. 29. However the trial was pushed back to Oct. 20 in an amended scheduling order filed on Aug. 7.

The NCAA has demanded a jury trial, so even if Fourqurean were to win in a speedy trial, the earliest he'd be eligible to play for the Badgers would be their Oct. 25 game at Oregon. Wisconsin coach Luke Fickell, who hadn't been directly involved in the case until now, wrote in a declaration supporting Fourqurean's motion for an injunction that Fourqurean being away from the team that long would jeopardize his health and future career chances.
"With a trial date set for October 20, 2025, Nyzier will lose the opportunity to compete and work against our best players on a daily basis until the resolution of the trial. As a result, his chances of continued growth and development will be greatly reduced. I also have concerns about Nyzier's physical safety and mental health after such a long time away from the program. Integrating Nyzier into a team that is seven or eight games into a twelve-game college football season, with no practice or game repetitions, will be virtually impossible and unworkable for both Nyzier and the team."
Separate from Fourqurean's lawsuit, Wisconsin has appealed to the NCAA on Fourqurean's behalf to get his year of eligibility, but the NCAA has not delivered a decision on that appeal.
Fourqurean practiced throughout training camp and took many first-team snaps with the defense over the last week sessions were open to reporters. He was able to do so because the NCAA lets players practice in a 30-day window as they await waiver appeals. That window closes Aug. 23 for Fourqurean, meaning he can no longer practice with the Badgers after Saturday. Wisconsin opens its season Aug. 28 against Miami (Ohio).
"My inability to participate in practices and games while the above litigation is pending significantly and irreparably harms my ability to continue developing as a player and team member and will result in additional delays in my ability to get back onto the field even if I am successful in proving my claims," Fourqurean wrote in a declaration filed with the court.
Wisconsin football could be without top TE for a while
"Specifically, if I am unable to continue practicing with the team during the pendency of the litigation, I will not be ready to play immediately upon reinstatement but instead will miss additional games while I work my way back to my position on the team."
Another factor in Fourqurean's motion for an injunction is the loss of revenue-sharing payments from Wisconsin. Fourqurean's attorney, Michael Crooks, filed under seal an NIL licensing agreement between Wisconsin and Fourqurean.
Fickell praised Fourqurean's work and focus this training camp.
"I have the utmost respect for Nyzier," Fickell said Saturday. "I don't know how he goes about his daily basis, to be honest with you. I mean, he doesn't show that there's anything going on. He's an example to everybody on this team, and it's not just the players, the coaches as well, because I can be a roller coaster daily getting getting a report on some of the things that are going on, but yet, he hasn't shown it and continues to go out there. And whatever role we've asked him to do, he's been a scout team guy most of camp, he's filled in when we'd need him to."
